These Terms of Service (“Terms”) govern your access to and use of the Site and any services, programs, communications, and online features offered by Body Lab Wellness and JennyO Fitness (collectively, “Body Lab,” “we,” “us,” “our”). By accessing or using the Site or services, you agree to these Terms. If you do not agree, do not use the Site.

Your use of the Site is also subject to our Privacy Policy and Privacy Choices pages, which describe how we collect and use data (including cookies/pixels) and how to opt out of certain uses.

MEDICAL EMERGENCY NOTICE: If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Site or our messaging to seek emergency care.

Eligibility:

You must be 18 years or older to use this Site and our services. You agree to provide accurate and complete information.

State Availability / Location Requirements

Body Lab Wellness is physically located in Maryland. Certain services (including telehealth and any prescription-related services) may be available in additional states through affiliated licensed providers and supporting platforms (including Qualiphy). Services are provided only where legally permitted and only to individuals located in states where our providers are licensed and where any prescription products may legally be fulfilled and shipped. Availability may change based on licensure, clinical appropriateness, pharmacy coverage, and regulatory requirements.

If services or prescription shipping are not available in your state, we may be unable to provide the requested service and may cancel and refund amounts paid for undelivered prescription products, subject to whether an order has already been processed by the pharmacy.

Use of Website

This Site is intended for informational, educational, and scheduling purposes related to Body Lab Wellness and JennyO Fitness services. You agree to use the Site only for lawful purposes and not to:

Appointments, Cancellations, and No-Shows

When booking appointments through this Site or by phone, you agree to provide accurate information.

Cancellation/no-show fees and required notice periods will be disclosed at booking and/or posted in-clinic, and the policy in effect at the time of booking generally applies. Body Lab may update scheduling requirements and appointment policies at any time.

Payments, Packages, Recurring Billing, Refunds, and Shipping

A) Payments Unless otherwise stated in writing, services must be paid in full at the time of service. We may use third-party payment processors.

B) Packages / Memberships / Subscriptions (If Applicable)

If you enroll in any package, membership, or subscription with recurring billing, you authorize us (and/or our payment processor) to charge your payment method on a recurring basis at the frequency disclosed at signup. Plans renew automatically unless canceled per the instructions provided at signup or by contacting us.

C) Subscription Cancellation Timing

To avoid being charged for the next billing cycle, cancellation requests should be submitted at least 48 hours before the next scheduled charge date, unless your plan terms state otherwise.

D) Refunds

Refund eligibility depends on the service/program and applicable clinic policy disclosed at purchase/booking. Services already rendered are generally non-refundable to the extent permitted by law. If any prescription products are fulfilled by third parties (e.g., pharmacies), those products are typically non-refundable once ordered or dispensed, except where required by law or in cases of documented error, damage, or loss.

E) Shipping & Returns

If you purchase any products that are shipped (including prescription products fulfilled by third-party pharmacies), shipping timelines, delivery requirements, refunds, returns, and replacement rules are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference. In the event of a conflict, the Shipping & Returns Policy will control for shipping/returns topics.

Text Messages (SMS) Terms

If you provide your phone number, you consent to receive service-related texts (e.g., appointment confirmations and reminders). If you opt in, you may also receive marketing/promotional texts.

•⁠ ⁠Opt-out: Reply STOP to unsubscribe. Reply HELP for help.

•⁠ ⁠You may receive one final confirmation text after opting out.

Intellectual Property

User Submissions & Testimonials

If you submit feedback, reviews, testimonials, or other content, you grant Body Lab Wellness a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display that content across our platforms for business purposes, unless prohibited by law. You agree not to submit unlawful, defamatory, or harmful material.

Disclaimer of Warranties

Limitation of Liability

To the fullest extent permitted by law, Body Lab Wellness, JennyO Fitness, and their owners, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Site, participation in programs, or reliance on content, including damages from inaccuracies, service interruptions, technical errors, unauthorized access, or health/fitness outcomes.

If liability is found, our total liability will be limited to the amount you paid to us for the specific service giving rise to the claim during the three (3) months preceding the event, unless otherwise required by law.

Indemnification

You agree to indemnify and hold harmless Body Lab Wellness, JennyO Fitness, and their owners, employees, contractors, and affiliates from claims, losses, damages, liabilities, and reasonable attorneys’ fees arising from your use of the Site, your violation of these Terms, or your violation of any rights of another.

Dispute Resolution: Binding Individual Arbitration; Class Action Waiver

A) Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or services will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except as noted below.

B) No Class Actions

You and Body Lab agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.

C) Exceptions

Either party may seek temporary injunctive relief in a court of competent jurisdiction to prevent misuse of intellectual property or unauthorized access to the Site. Small claims court claims may be brought if they qualify and remain individual.

D) Location / Governing Law for Arbitration

Unless otherwise required by law, arbitration will take place in Maryland (or remotely by agreement). These Terms are governed by Maryland law to the extent not preempted by federal law, including the Federal Arbitration Act.

Changes to Terms

We may update these Terms at any time. Changes are effective when posted on this page. Continued use of the Site signifies acceptance of the updated Terms.
